Terms of Service
Draft date: 21 October 2026
Draft, pending review by qualified counsel. These terms describe use of the website. They are not a certification program, a customer agreement, or a completed legal review.
1. Acceptance
Living Proof Labs, LLC (“we”) publishes livingprooflabs.com (the “Site”). If you use the Site, you accept this draft. If you do not, do not use the Site.
We may replace this draft by publishing a newer version at this URL. The draft date above is the version you are reading.
2. What the Site is
The Site tells you who the company is and how to contact us. It is informational. It is not an offer to verify a robot, issue a certificate, or provide a physical test facility, and it does not by itself create a services contract. Work of that kind, if any, is agreed separately.
3. Acceptable use
Use the Site only in a lawful way. You may read it, link to it, and use automated access that does not degrade it. The company is AI-native, and these terms do not ban ordinary crawlers or other non-disruptive automation.
You may not:
- Break a law that applies to your use of the Site
- Attempt to gain access you were not given
- Interfere with the Site, overload it, or bypass a control
- Impersonate Living Proof Labs, LLC or misstate your connection to us
4. Intellectual property
The text, robot mark, and visual design of the Site belong to Living Proof Labs, LLC or its licensors. Viewing the Site lets you read it. It does not transfer those rights, and it does not let you use the name or the mark as your own.
A license for the source code, if the company adopts one, will be a separate
LICENSE file in the
repository. These
terms do not grant that license. Branding, page text, and other creative assets
are not included in a source-code license unless that file says so.
5. No warranty
The Site is provided as is and as available. To the fullest extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that the information on it is complete or current.
6. Limitation of liability
To the fullest extent the law allows, Living Proof Labs, LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, use, or goodwill, arising from your use of the Site or your inability to use it.
If a liability remains, it is limited to the amount you paid us to access the Site. Access to the Site is free, so that amount is zero unless a separate written agreement says otherwise. Some laws do not allow these limits. Where they do not, the limit is the smallest the law allows.
7. Forward-looking statements
The Site may describe work we intend to do, including a verification platform and physical test facilities. Those statements can turn out differently. We do not undertake to update them except by changing the Site.
8. Other sites
Links go to sites we do not operate, including case studies and a professional profile. Their content and policies are their own.
9. Indemnity
If your use of the Site or your violation of these terms leads to a claim against Living Proof Labs, LLC, you will cover the resulting loss and reasonable legal fees, to the extent the law allows. Counsel still needs to confirm how broad this sentence should be.
10. Governing law
This draft does not choose a governing law or a court. Living Proof Labs, LLC is based in Sausalito, California. Qualified counsel must confirm the governing law and the venue before these terms are final.
An earlier draft selected the laws and courts of Switzerland. That selection is not carried forward.
Before a formal dispute, write to [email protected] so we can try to resolve it directly.
11. Severability
If a provision cannot be enforced, it is limited to the extent it must be, and the rest remains.
12. Whole agreement for the Site
These terms and the Privacy Policy are the whole agreement about use of the Site. They are not the agreement for paid work, which has to be written separately.
13. Contact

14. Open points for counsel
- Governing law and venue. Do not assume Switzerland. Do not treat California as selected either, until counsel confirms it.
- How narrow the warranty disclaimer, liability cap, and indemnity should be.
- The source-code license. Publish a license statement only after a
LICENSEfile is chosen and added. Branding and other assets stay outside that file unless it says otherwise. - Whether acceptable use should be tighter than “non-disruptive automation is allowed.”
- Whether [email protected] should remain the published legal address. Domain mail is forwarded by a catch-all. A test message was not sent.
